Copyright Policy
Black Saints LLC respects the intellectual property rights of others and expects the same of anyone who uses Black Saints Direct.
1. Reporting infringement
If you believe that content on the Black Saints Direct site — including product images, descriptions, or other materials — infringes your copyright, we will respond appropriately to notices of alleged infringement that comply with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512(c)(3). Send any notice of infringement to our designated copyright agent, below. Your notice must:
- identify in sufficient detail the copyrighted work or intellectual property you claim has been infringed;
- provide the electronic or physical signature of the copyright owner or a person authorized to act on the owner's behalf;
- include a statement that you have a good faith belief the disputed use is not authorized by the copyright owner, its agent, or the law;
- include a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; and
- include your name, mailing address, telephone number, and email address.
Submit your notice of alleged infringement to our designated copyright agent by mail or email:

2. Consequences of a false notice
You may be liable for damages, including court costs and attorneys' fees, if you submit a notice under Section 1 and materially misrepresent that content on the site is infringing. Upon receiving a proper notice, we will remove or disable access to the allegedly infringing material and promptly notify the party who posted it, who may respond using the DMCA counter-notification process described below.
3. Counter-notification
If you believe your own material was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our designated copyright agent under 17 U.S.C. § 512(g)(2) and (g)(3). To be effective, your counter-notification must include:
- identification of the material that was removed or disabled, and its location before removal;
- a statement that you consent to the jurisdiction of the Federal District Court for the judicial district where your address is located (or, if outside the United States, any district in which Black Saints may be found);
- a statement that you will accept service of process from the party who filed the original notice, or that party's agent;
- your name, address, and telephone number;
- a statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification; and
- your physical or electronic signature.
Submit your counter-notification to the same designated copyright agent listed above.
4. Restoration of material
If you materially misrepresent that removed or disabled content was taken down by mistake or misidentification, you may be liable for damages, including costs and attorneys' fees. If we receive a valid, written counter-notification meeting the requirements of Section 3, we will restore the removed or disabled material within ten to fourteen business days of receiving it, unless our designated agent first receives notice that the party who filed the original infringement notice has filed a court action seeking to restrain the alleged infringer from engaging in infringing activity relating to the material.
